    346.1      -     Nondiscriminatory Testing

    Nondiscriminatory testing shall be provided for all students. Children with impaired sensory, physical or speaking skills who are referred for multidisciplinary team evaluation may need a specialized evaluation procedure to ensure that the tests used are not biased against the individual child. Such an evaluation may include the use of specialized tests which are nonverbal, “culture free,” criterion based or appropriately adapted tests.

    Children for whom English is a second language may need to be evaluated by a trained test administrator who is bilingual. In such cases, a bilingual test administrator will be hired on a case-by-case basis. The tests and interviews will be administered in the child’s primary language of the home.

    Supervision of multidisciplinary team evaluations provided by the director of special education will include monitoring of evaluations to ensure that they are nondiscriminatory and the placement in special education is based on data broader than a single intelligence score.

    Children of minority groups shall have the right to have consultation from a minority group representative to their multidisciplinary team.
